LOS ANGELES -- A judge Thursday rejected an urgent request by Shelly Sterlings attorney asking that husband Donald Sterling and his lawyers be ordered to stop harassing her legal team and doctors in their dispute over the planned sale of the Los Angeles Clippers. A petition filed by Shelly Sterlings attorneys quoted allegedly threatening remarks made by Donald Sterling in phone calls and a letter sent by his lawyer to two doctors who declared him mentally incapacitated. Superior Court Judge Michael Levanas said the matter may involve "high emotions and some litigation posturing" and urged both parties to tone down their communications. "The court does not feel that the statements set forth in the ... petition rise to the level of great and irreparable injury to a party as called for in the Code of Civil Procedure," Levanas said in a written decision. Outside court Donald Sterlings attorney Bobby Samini said, "Clearly from the courts ruling its apparent Mr. Sterling is not a danger to anybody." A trial next month will look into assertions that Donald Sterling is mentally incapacitated and determine whether he was properly removed as an administrator under the terms of the family trust, which owns the Clippers, leaving Shelly Sterling alone as trustee with authority to sell the team. A $2 billion sale to former Microsoft CEO Steve Ballmer is pending. The physicians who determined he was mentally incapacitated in May examinations with Donald Sterling could be key witnesses in the trial. A filing by Shelly Sterlings attorney stated that on June 9 Donald Sterling called Shelly Sterlings attorney, Pierce ODonnell, threatening lawsuits and said: "I am going to take you out, ODonnell." ODonnell understood that to be a death threat. The document also alleged Donald Sterling called one of the physicians, Dr. Meril Platzer, told her shes "nothing but a fraud and a liar and a cheat" and menacingly warned, "Im going to see that you lose your license." He also is said to have threatened to sue Platzer and made similar threats in a profanity-laden message left for a second doctor, James E. Spar. "Im gonna get you fired from UCLA because youre nothing but a tramp. How dare you let someone use you that way?" Sterling tells Spars voicemail. "You know, you rely on doctors. You think that theyll be above it all. But obviously youre not. Youll sell yourself for nothing. How dare you? How dare you give my records to a lawyer for the purposes of using it against me?" The filing states that Sterlings lawyer Samini, followed up with a letter to each doctor accusing them of being a part of a conspiracy. The document called it a clear attempt to intimidate key witnesses in the case. Samini said his office had been bombarded with calls from representatives of Shelly Sterling urging them to settle the case. He contended that the call cited in ODonnells papers was made by ODonnell to his office and he turned the phone over to Donald Sterling. "They wanted to have a conversation," he said of Sterling and ODonnell, but he listened from a distance. "It was quite entertaining," Samini said. "I didnt hear any threats." Samini said he wrote letters to the doctors because he felt Donald Sterlings medical records were disseminated to the media inappropriately. He also said he believed that the doctors had been hired to give specific evaluations of Donald Sterling, which were suggested to them by Shelly Sterlings team. Samini said he has engaged other doctors to examine Donald Sterling and "the results are different and there are more to come." He said those would be released in court during the trial now scheduled for July 7. The terms of the trust state that two licensed physicians can determine a trustee "incapacitated" and both parties must co-operate in any such examination. Both Sterlings signed the terms, which also waive doctor-patient privilege and privacy rights for any "incapacitation" finding. Outside court, ODonnell said about the statement by Donald Sterling, "I took that as a threat on my life and I still do." He said Sterling used numerous expletives. "We think this is evidence of his lack of control, his impulsivity." He pointed out that the comments came the same day that Sterling went on a rant about the NBA, calling its board members "despicable monsters." He also said the doctors threatened by the 80-year-old Donald Sterling were shaken and one of them, Platzer, said she had misgivings about whether she should have gotten involved in the case at all. In her declaration she wrote that she believed Donald Sterling and his attorneys are "attempting to bully me into changing my opinion regarding Mr. Sterlings incapacity. I also do not want to be intimidated if I testify in this matter." ODonnell said he would ask for an injunction prohibiting Donald Sterling from intimidating witnesses. "This is not normal behaviour in civil litigation," ODonnell said. "This shows how erratic and volatile he is." FIVE QUICK NBA THOUGHTS 1. TORONTO RAPTORS: They lose on the road by five to Miami and by seven at Indiana. It just has a different feel to it. Even though they lost, Im impressed with their improvement and the way theyre playing right now. Good role definition and team play are evident. Have they arrived? No, far from it, but they are headed in the proper direction. Its a lot more difficult to play when folks have expectations for you and how you handle them on a daily basis. If they can become consistent in their production then theyll be fine. Greivis Vasquez has to start playing a lot better and with consistency off the bench for them. Hes the guy that can make a difference for them with the second unit if he can pick it up a few notches. 2. ROY HIBBERT (Pacers): We talk so much about his defence, shot blocking and rebounding that at times we lose sight of how much hes improved. Hes always been a nifty passer back to his days at Georgetown but the thing thats really impressed me has been his steady growth as a post player. His footwork is exceptional and he can score with either hand in the lane and is fluid with his skills. He gets great position in the lane and his confidence as an offensive player is at an all-time high. 3. LUOL DENG TRADE: I like this trade for the Bulls. Theyre not going anywhere with the loss of Derrick Rose and had to move on from this group. Deng was a terrific player for them yet was going to cost too much for them in the free-agent sweepstakes. They save close to $20 million with this transaction and it was time to move on and begin the process of a new look in Chicago. GOLDEN STATE WARRIORS: Theyre on a roll with 10 wins in a row and Im thrilled for their loyal/rabid fan base. If I could put a finger on it the one guy who makes such a huge difference on their team is Andre Iguodala. He gives them a perimeter defensive stopper, hes an unselfish player who gladly gives the ball up to teammates and has wonderful versatility in his game. He plays the game the right way and has really allowed the other aspects of this roster to settle into their roles. MOSCOW -- Russian President Vladimir Putin has offered new assurances to gay athletes and fans attending the 2014 Sochi Winter Olympics next month. Yet he defended Russias anti-gay law by equating gays with pedophiles and said Russia needs to "cleanse" itself of homosexuality if it wants to increase its birth rate. Putins comments in an interview broadcast Sunday with Russian and foreign television stations showed the wide gulf between the perception of homosexuality in Russia versus the West. A Russian law passed last year banning "propaganda of nontraditional sexual relations" among minors has caused an international outcry. Putin refused to answer a question from the BBC on whether he believes that people are born gay or become gay. The Russian law, however, suggests that information about homosexuality can influence a childs sexual orientation. The law has contributed to growing animosity toward gays in Russian society, with rights activists reporting a rise in harassment and abuse. International worries about how gays will be treated in Sochi have been met with assurances from Russian officials and Olympics organizers that there will be no discrimination, and Putin reiterated that stance. "There are no fears for people with this nontraditional orientation who plan to come to Sochi as guests or participants," Putin declared in the TV interview. He said the law was aimed at banning propaganda of homosexuality and pedophilia, suggesting that gays are more likely to abuse children. Making another favourite argument against homosexuality, Putin noted with pride that Russia saw more births than deaths last year for the first time in two decades. Population growth is vital for Russias development and "anything that gets in the way of that we should clean up," he said, using a word usually reserved for military operations. The law on propaganda has been used to justify barring gay pride rallies on the grounds that children might see them. This has raised the question of how athletes and fans would be treated for any gay-rights protests during the Olympics. When asked about this by the ABC TV channel, Putin said protests against the law itself would not be considered propaganda. DAVIE, Fla. -- In a culture that fosters conflict, Jonathan Martin sought to avoid it. Upset by treatment he considered abusive, the Miami Dolphins tackle let the situation fester for months before leaving the team last week. Martins agent then complained to the Dolphins, who suspended guard Richie Incognito. The NFL is investigating whether Incognito harassed or bullied Martin, and whether their teammates and the organization mishandled the matter. Some say Martin, a Stanford graduate who went about his business quietly, handled the situation well. But pro football is a macho world, and some players believe Martin should have responded more firmly. "Is Incognito wrong? Absolutely. Hes 100 per cent wrong," New York Giants safety Antrel Rolle said. "No individual should have to go through that, especially in their workplace. "But at the same time, Jonathan Martin is a 6-4, 320-pound man. I mean, at some point and time you need to stand your ground as an individual. Am I saying go attack, go fight him? No. I think we all understand we can stand our ground without anything being physical." Dolphins players have robustly defended Incognito, long considered among the NFLs dirtiest players. Hes now a notorious national villain, but teammates praise his leadership and loyalty. Theyve been less passionate in their support of Martin, saying he and Incognito behaved like best friends. "They did a lot of stuff together," tackle Tyson Clabo said. "So if he had a problem with the way he was treating him, he had a funny way of showing it." Martin is with his family in California to undergo counselling for emotional issues. A senior partner in a New York law firm was appointed by NFL Commissioner Roger Goodell to investigate possible misconduct and prepare a report. DeMaurice Smith, executive director of the NFL Players Association, said Thursday that he continues to be in touch with those involved. "The NFLPA has taken steps to ensure that every one of our affected members is represented," Smith said in a statement. "It is our duty as a union to learn the full facts, protect the interests of players involved and hold management accountable to the highest standards of fairness and transparency." The alleged bullying saga engulfing the Dolphins has shed a light on how damaging perceptions can be in the violent world of the NFL. A Pittsburgh native, Martin is the son of Harvard graduates and his great grandfather also graduated from the school in 1924. At Stanford he protected Andrew Lucks blind side, and also majored in the classics. Taken in the second round of the 2012 draft, Martin has what it takes physically to be an NFL player -- size, skill, athleticism, intelligence. He won praise from the Dolphins for his diligent study of game and practice video. But while has been a starter since the first game of his rookie season, Martin developed a reputation in the NFL for lacking toughness. That impression might have been reinforced by the way he handled his issues with Incognito, current and former teammates acknowledge. "A lot of people might look at Jonathan Martin and think that hes soft because he stepped away from the game, and say, Why dont you just fight him?" said Seattle Seahawks receiver Doug Baldwin, who played with Martin at Stanford. "Well, if you look at it with common sense and being logical, what options did Jonathan Martin have? "He could fight Richie Incognito. He could go and tell on the players, which we know in the football locker room doesnt go over too well. Or he could remove himself from the situation and let the proper channels take care of itself. And I think he made the intelligent, smart choice without putting himself or Richie Incognitos physical abilities in danger." Houston Texans Antonio Smith, who has accused Incognito of dirty play since they went against each other in college, said Martin should have responded more forcefully. Smith drew a three-game suspension this year for taking Incognitos helmet and hitting him during an exhibition game. "I dont think that in my opinion a grown man should get bullied," Smith said. "And I think that if youre realistically getting bullied, theres only one way my mom taught me and my dad taught me how to get rid of bullies. They used to always say, You hit a bully in the mouth. It will stop him from bullying, no matter what you hit him with." Djokovic extended his recent dominance over Rafael Nadal by rallying for a 4-6, 6-3, 6-3 victory Sunday to win the Italian Open for the third time -- then dedicated the title to his flood-hit native Serbia by carving a heart on the clay with his racket.
